The Hon. Huelva City Council informs users that the information and contents provided in this electronic site are provided by the different Municipal Services and Departments.

In compliance with the provisions of article 10 of Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce, we inform you that www.huelva.es is a domain name, the owner of which is the Hon. Huelva City Council, which, through its electronic headquarters, provides services, activities and actions within its scope of action related to information society services. For the purposes of the mentioned Article 10, the details of the entity are as follows

This Legal Notice regulates the conditions of use of the electronic site www.huelva.es. Any person accessing it assumes the role of user, undertaking to observe and comply with the provisions included therein as well as its correct use in accordance with the applicable legislation, and is liable for any damages that may be caused by non-compliance with this obligation. The processing of personal data carried out through this electronic office will be subject to the provisions of Organic Law 15/1999, of 13 December, on the Protection of Personal Data and other applicable regulations, as set out in the “Privacy Policy” contained therein.

1.Intellectual and Industrial Property

The intellectual property rights belong to the Hon. Huelva City Hall, therefore, this electronic site and all its contents, texts, images, graphics, audio and any other materials are the property of the Hon. Huelva City Hall. The trademarks or distinctive signs of the Hon. Huelva City Council contents in the electronic site are protected by industrial property legislation. The designs, logos, text and/or graphics that do not belong to the Hon. Huelva City Council that may appear on the website belong to their respective owners, who are responsible for any possible controversy that may arise with respect to the same.

2.Conditions of use

2.1 GENERAL CONDITIONS

Access to the electronic headquarters of the Hon. Huelva City Council as well as the use that may be made of the information contained therein, are the sole responsibility of the user. The user undertakes to access the electronic site and use its contents in a diligent, correct and lawful manner and, in particular, undertakes to make use of the information and/or services offered in accordance with the regulations in force at any given time. The Hon. Huelva City Council shall not be liable in any case for the use that users and/or third parties may make of its electronic site or its contents, nor for any damages that may derive therefrom, including computer damage or viruses. The Hon. Huelva City Council excludes all liability for any damage or harm to the user’s software or hardware that may arise from access to this electronic site, as well as from the use, transmission, dissemination, storage of information or applications contained therein. The Hon. Huelva City Council may, at any time and without prior notice, make the necessary modifications and updates to the information contained in its electronic site. Its operation is constantly checked to ensure that it functions correctly 365 days a year. However, we do not rule out the possibility of certain programming errors or the occurrence of force majeure, natural catastrophes or similar circumstances that make it impossible, at any given time, to access its electronic site. The Hon. Huelva City Council will make every effort to avoid errors and, in any case, to repair or update them as soon as possible, excluding any liability for damages caused by temporary interruptions or failures in access to the same.

2.2 SPECIFIC CONDITIONS FOR THE USE OF THE OPEN GOVERNMENT PLATFORM

2.2.1 Applicable conditions

The use of the Huelva City Council’s Open Government platform is subject to the terms of use and privacy policy of the Municipal Website, in addition to the following specific conditions, whose objective is to guarantee that citizens can send their comments, contributions and proposals, as well as make use of the participatory channels offered by the platform, all within a framework of respect and legality.

2.2.2 Purpose

The user undertakes to make appropriate use of the platform for its participatory purpose and not to use it to engage in activities that are unlawful; contrary to good faith; that violate or transgress the honour, personal or family privacy or the image of persons; or that involve acts of unfair competition or unlawful advertising.

2.2.3 Responsibility for the content provided

The User is solely responsible for the contents, comments and files that he/she may make available through the platform. Huelva City Council excludes all liability for damages of any kind that may arise from the content provided by users, as well as for the opinions expressed by them.

The user acquires an obligation of truthfulness regarding the content provided on the platform, whereby the user undertakes not to incur in a lack of truthfulness, accuracy, completeness, relevance and/or timeliness of the content.

The user undertakes not to publish (or upload) any file that is subject to the intellectual or industrial property rights of third parties, unless the holder of such rights has granted a licence or formal authorisation.

2.2.4 Content moderation

The platform has a system for moderating comments, contributions and proposals, the purpose of which is to prevent the publication of content that infringes these Conditions or any other applicable regulation. The user accepts that the contents provided will be supervised by the Huelva City Council and, in the case, removed from the platform. In the case of disagreement, the user may contact the City Council by means of the mechanisms available on the Municipal Website, or by any other legally appropriate means.

Contributions that are not considered by Huelva City Council to fall into the category of comments, contributions or proposals because they are a complaint, suggestion or request for information will be referred to the Complaints and Suggestions Service for processing and/or resolution.

2.2.5 Communications with users

The User expressly accepts that the e-mail address that, in their case, has been provided for communications with the City Council is correct and truthful, and that communications addressed to the same will be considered effective for all purposes.

2.3 GENERAL CONDITIONS FOR GENERAL MOBILITY FOR THE PROVISION OF REUSABLE DOCUMENTS OF HUELVA CITY COUNCIL

2.3.1 Obligatory nature of the general conditions

These general terms and conditions, which are permanently available under Legal Notice, bind any reusing agent by the mere fact of making use of the documents subject to them.

2.3.2 Authorisation for re-use and non-exclusive transfer of intellectual property rights

These general terms and conditions allow the re-use of the documents subject to them for commercial and non-commercial purposes. Re-use is understood as the use of documents held by the Huelva City Council and other agencies and entities included in the subjective scope of the Electronic Administration Ordinance by Article 1.2 thereof, by natural or legal persons, for commercial or non-commercial purposes, provided that such use does not constitute a public administrative activity. For example, authorised re-use includes activities such as copying, disseminating, modifying, adapting, extracting, rearranging and combining information.

An electronic document is any representation of text, image, sound or video, or combinations of all or some of these elements, which has been encoded by the use of an information processing programme and is readable thanks to the same programme used for its generation or an equivalent programme, and is susceptible to individualised processing. Furthermore, for the purposes of these general terms and conditions, databases and collections of data are expressly included.

Re-use entails the free and non-exclusive transfer of the intellectual property rights, if any, corresponding to such documents, authorising the reproduction, distribution, public communication or transformation activities that are necessary to carry out the authorised re-use activity, in any modality and in any format, for everyone and for the maximum period permitted by law.

2.3.3 General conditions for re-use

The following general conditions apply for the re-use of documents:

  • It is forbidden to distort the meaning of the information.
  • The source of the documents to be re-used must be cited. This citation may be made in the following way: “Origin of the data: Huelva City Council (or, in its case, the administrative body, organisation or entity concerned)”.
  • The date of the last update of the documents subject to re-use should be mentioned, provided that it was included in the original document.
  • It may not indicate, insinuate or suggest that the Huelva City Council participates in, sponsors or supports the re-use of the information.
  • Metadata on the date of update and applicable conditions for re-use included, if any, in the document made available for re-use must be retained, not altered or deleted.

2.3.4 Exclusion of responsibility

The use of the datasets shall be made by the users or re-use agents at their own risk, and they alone shall be liable to third parties for any damage arising therefrom.

The Huelva City Council shall not be liable for the use made of its information by the reusing agents, nor for any damages suffered or economic losses that, directly or indirectly, produce or may produce economic, material or data damages, caused by the use of the reused information.

The Huelva City Council does not guarantee the continuity in the availability of the reusable documents, neither in content nor in form, nor does it assume responsibility for any error or omission contained therein.

2.3.5 Responsibility of the reusing agent

The re-using agent is subject to the applicable regulations on the re-use of public sector information, including the penalty regime provided for in Article 11 of Law 37/2007, of 16 November, on the re-use of public sector information.

The links contained in the electronic site of the Hon. Huelva City Council can direct to third party websites about which the Hon. Huelva City Council does not exercise any control, and therefore assumes no responsibility for the content, information or services that may appear on these sites and consequently shall not be liable in any case for any damages that may arise.

4.Applicable Law and Jurisdiction

For the resolution of all disputes or questions related to this website or the activities carried out therein, Spanish legislation shall apply, to which the parties expressly submit themselves, and the Courts and Tribunals of Huelva shall be competent for the resolution of all disputes arising from or related to its use.
